The Arizona Emergency Response Commission DOES NOT, at this time, accept "Tier2 Submit" software program filings. The preferred method of filing with the AZSERC is by filing online at this AZSERC website. Filing online replaces the need to file with all Arizona LEPCs and many fire departments {A.R.S. 26-350 (C)(D)(E)}.

In July of 2013, Governor Jan Brewer signed HB 2174 related to the Tier II Report filing fees.  This law became effective in October of 2013.   AZSERC will however be waiving the fee for the reporting year of 2013.  The fees will take effect for the 2014 reporting year which will be January 1st, 2015.  Explanation of the law is listed as follows:

"(a) For each facility required to file one (1) or more hazardous chemical inventory reports (Tier II Reports), under the provisions of 42 U.S.C. § 11022, an annual fee of seventy-five dollars ($75.00), and an additional fee of twenty dollars ($20.00) for each additional required location for that reporting year with a  maximum cap limit of five hundred dollars ($500).  (Examples or this include Company’s with multiple locations around the State of Arizona would be required to pay seventy-five dollars ($75.00) for their first Tier II Report and twenty – dollars for every additional report up to a cap of five hundred – dollars ($500)."

EXEMPTIONS: (Are Exempt From Paying Fees)

AZSERC continues to provide one of the best Online Tier II Programs in the Nation, and we would like to continue to make it more user friendly and have Fire Department and Local Emergency Planning Committees continue to benefit from the data that is stored in the system.   If you have any questions regarding these fees, please contact Mark Howard, Executive Director, at (602)464-6345 or by email at [email protected].
